Understanding Probate and Trust Administration in San Diego

Probate and trust administration make sure that a person’s estate is managed and distributed according to their wishes after death.

Probate involves court supervision to validate a will, settle debts, and transfer assets to heirs, while trust administration allows assets placed in a trust to pass directly to beneficiaries, often without court involvement.

In San Diego County, these matters are governed by the California Probate Code and typically handled through the San Diego Superior Court. The court manages filings for San Diego and nearby communities, providing accessible procedures for executors, trustees, and families going through  the process.

With property values in neighborhoods such as La Jolla and Point Loma, local estates often include substantial real estate holdings, business interests, and investment portfolios. These complexities make careful legal guidance necessary to protect assets, meet deadlines, and maintain compliance with California’s probate and trust laws.

Working with a San Diego-based probate and trust administration attorney helps families handle these responsibilities efficiently, reducing delays, avoiding disputes, and making sure that every step aligns with state and local requirements.

Our Probate & Trust Administration Process in San Diego

Our attorneys guide families through each stage with focus and precision.

Probate Process in San Diego

  1. Petition and Filing. We begin by filing the petition at the San Diego Superior Court Central Courthouse, making sure all documents are accurate and complete.
  2. Notices and Hearings. Beneficiaries and creditors receive proper notice. We represent clients at required hearings and address any objections or challenges.
  3. Inventory and Appraisal. All estate assets are catalogued and valued. In San Diego, this often includes high-value homes in Del Mar and more.
  4. Debt Settlement and Taxes We help settle valid debts and address tax obligations to protect estate value.
  5. Distribution of Assets Once the court approves, property and funds are distributed according to the will or California intestacy law.

Trust Administration in San Diego

While trust administration can avoid full court involvement, disputes are common. In San Diego, the most frequent conflicts include:

  • Trustee mismanagement or failure to provide timely accounting
  • Inheritance disputes among siblings over beach houses or vacation properties
  • Conflicts over charitable gifts involving UC San Diego or local foundations
  • Claims of undue influence in cases involving elderly or vulnerable beneficiaries

When disputes escalate, we are ready to resolve them in or out of court. For San Diego families, a trusted attorney means the difference between efficient administration and years of costly litigation.

What Are the Duties of a Successor Trustee in San Diego?

A successor trustee is responsible for managing and distributing the assets held in a trust after the trust creator’s death or incapacity. In San Diego, this means making sure all actions comply with the California Probate Code while also following any specific terms outlined in the trust document.

Key duties include protecting trust assets, paying outstanding debts and taxes, keeping detailed records, and providing accountings to beneficiaries. The trustee must also distribute property according to the trust’s instructions.

Because each step must meet both state and fiduciary standards, many trustees in San Diego County work with a trust administration attorney to help manage filings, avoid liability, and confirm every obligation is handled correctly and transparently.

Local Courts & Resources We Work With In San Diego

This courthouse handles probate, trust, conservatorship, and guardianship matters for the county. It is fully ADA-accessible, with nearby parking structures and public transit connections at C Street and Union Street.
  • UC San Diego (UCSD)
Charitable gift disputes and endowment-related trust issues often involve the university, particularly in La Jolla and University City.

I don’t trust 90 percent of attorneys forever. I trust Ryan. My issue has been going on for nine years. I finally have traction and intend to prevail. After a court action in the New Year I will hire Ryan for the new actions.

Amy and her team are excellent. They formed the Special needs trust form my daughter and helped us with the administration of it during my daughter’s life. The law firm who we were dealing with the claim of the accident and who we are very grateful with, because of their humbleness and experience in accidents, they did what others firms didn’t even consider trying. After the accident case was settled, we needed a trust to receive the funds on behalf of my daughter and they try to set it up, but after a few hearing with the courthouse they just said, go see Amy, We did, and oh my goodness, they were able to set and get it approved in just one hearing. This is amazing for what I saw in the court room. Some cases NOT HANDLED by Amy, that I was able to hear during the several times we were in the court room with the accident attorney, some cases were already into 2 years and not resolved. When Amy took our case in her hands. Her staff was so professional that in the first try, the trust was approved by the court. In addition, they were very caring and supportive to us during the time of our relationship as client and attorney, and even though our relationship has ended after the passing of our daughter, I know that if in any case I need someone who I can fully trust blindly this is Amy and her team. If you are looking for fast, reliable and a accurate results look no more, Amy and associates is who you are looking for.

Sincerely

Sergio Mendoza

Joe Patton has been a terrific estate planning resource. He’s very knowledgeable and well-versed. He’s a higher-end attorney but he helped us understand the complexities of setting up a revocable trust and took the time to answer all of our questions candidly (and make suggestions surrounding those hypothetical circumstances). My husband and I feel very fortunate to know him and to know now that our affairs are in order should the unthinkable occur. We’d both highly recommend his counsel as we know him to be very hard-working and honest. He’s a good guy!
