When trust disputes enter probate court in California

November 14, 2025

Trust disputes involving your client can start quietly, but escalate into probate litigation. As an estate planner or estate planning attorney, you can navigate these situations more efficiently and strategically when you partner with litigation counsel who is experienced with California’s probate courts and laws.

Why trust disputes reach court

Disagreements over a trust happen in many ways. A family member may question recent changes or beneficiaries may feel their interests receive unequal consideration. When discussion and negotiation fail, the Superior Court of California’s Probate Division provides a structured forum for resolution. The court holds exclusive jurisdiction over the internal affairs of the trust Probate Code §17000.

Probate litigation proceedings in California involve strict deadlines, extensive documentation and formal testimony. Lawyers with extensive probate and trial experience can help you handle complex issues while protecting the people you represent.

The critical 120-day contest rule

A key deadline in trust disputes involves the 120-day contest rule:

  • Serve the Notice of Trust on all beneficiaries and heirs when a revocable trust becomes irrevocable, usually after the settlor’s death.
  • Track the 120-day timeframe that begins when you serve proper notice.
  • Respond promptly and strategically to protect your clients’ interests within the limited period.

Following these steps carefully can help you safeguard your clients and address disputes effectively.

Steps to manage a California probate dispute

You can approach a California probate trust dispute by:

  • Reviewing the trust documents carefully to identify issues and potential remedies
  • Collecting relevant records, including financial statements, prior trust versions and communications
  • Preparing for trial and negotiation with a trusted litigation partner
  • Exploring possible resolutions outside of court when possible while staying ready if the case proceeds to litigation

Attending each step thoroughly and applying your courtroom knowledge may help you guide your clients through the process and improve the chances of a favorable outcome.

How you benefit from a litigation partner

Working with a specialized California probate litigation firm may allow you to focus on your estate planning practice while complex disputes receive professional attention. A skilled litigation partner brings deep trial experience and a thorough understanding of California probate procedures. You gain direct, rapid communication to address questions without delays.

Experienced support staff can manage all aspects of a case while delivering high-touch service often associated with much larger firms. Partnering with the right firm may help you respond efficiently, set client expectations clearly and resolve contested trusts with confidence.

Navigating trust disputes with confidence

Trust disputes can create stress and uncertainty for your clients and their families. When conflicts reach probate court, you can guide the process strategically and more efficiently with a responsive and knowledgeable litigation team.

I don’t trust 90 percent of attorneys forever. I trust Ryan. My issue has been going on for nine years. I finally have traction and intend to prevail. After a court action in the New Year I will hire Ryan for the new actions.

Amy and her team are excellent. They formed the Special needs trust form my daughter and helped us with the administration of it during my daughter’s life. The law firm who we were dealing with the claim of the accident and who we are very grateful with, because of their humbleness and experience in accidents, they did what others firms didn’t even consider trying. After the accident case was settled, we needed a trust to receive the funds on behalf of my daughter and they try to set it up, but after a few hearing with the courthouse they just said, go see Amy, We did, and oh my goodness, they were able to set and get it approved in just one hearing. This is amazing for what I saw in the court room. Some cases NOT HANDLED by Amy, that I was able to hear during the several times we were in the court room with the accident attorney, some cases were already into 2 years and not resolved. When Amy took our case in her hands. Her staff was so professional that in the first try, the trust was approved by the court. In addition, they were very caring and supportive to us during the time of our relationship as client and attorney, and even though our relationship has ended after the passing of our daughter, I know that if in any case I need someone who I can fully trust blindly this is Amy and her team. If you are looking for fast, reliable and a accurate results look no more, Amy and associates is who you are looking for.

Sincerely

Joe Patton has been a terrific estate planning resource. He’s very knowledgeable and well-versed. He’s a higher-end attorney but he helped us understand the complexities of setting up a revocable trust and took the time to answer all of our questions candidly (and make suggestions surrounding those hypothetical circumstances). My husband and I feel very fortunate to know him and to know now that our affairs are in order should the unthinkable occur. We’d both highly recommend his counsel as we know him to be very hard-working and honest. He’s a good guy!
