Why Choose The Estate Lawyers, APC for Estate Litigation in Newport Beach?

A Litigation-Only Firm

We don’t draft wills or handle real estate closings. Trust, probate, and elder law litigation is our entire practice, so courtroom strategy is second nature.

Board-Certified Legal Team

Our firm is led by board-certified specialists in estate litigation, a credential held by only a small fraction of California attorneys.

Recognized by Super Lawyers® and AVVO

Our attorneys have earned peer-nominated Super Lawyers® recognition and strong AVVO ratings, reflecting respect from both colleagues and clients.

150+ Years of Combined Litigation Experience

Our team brings over 150 years of combined experience battling trust contests, will challenges, fiduciary disputes, and elder financial abuse cases.

Strong Local Court Relationships

Decades of practice across Orange County and Southern California probate courts means we know the judges, the clerks, and the local procedures that move cases forward.

A Team That Truly Cares

Protecting elderly clients and honoring their wishes drives everything we do. Clients consistently tell us they felt heard, respected, and aggressively defended.

When Should You Hire an Estate Litigation Attorney in California?

You should consider speaking with an estate litigation attorney if:

  • A trustee is withholding records, delaying distributions, or paying themselves without explanation
  • A new will or trust amendment appeared shortly before death
  • A caregiver, new spouse, or one beneficiary suddenly received a larger share of the estate
  • An elderly parent was isolated, pressured, or moved money while showing signs of cognitive decline
  • Bank accounts, real estate, or beneficiary designations were changed under suspicious circumstances
  • Assets are missing, transfers are unexplained, or estate records do not match what your loved one told you
  • A sibling, co-beneficiary, executor, or trustee is blocking access to information or refusing to communicate

These issues can point to deeper problems such as undue influence, lack of capacity, breach of fiduciary duty, or financial elder abuse. A consultation with The Estate Lawyers, APC can help determine whether you have a valid claim, what deadlines apply, and what steps may be needed to protect your rights.

How Estate Litigation Works in California

Most California estate disputes begin in probate court. Cases involving wills, trusts, executor conduct, or trustee misconduct are usually filed in the probate division of the county superior court.

For Newport Beach residents, that often means the Orange County Superior Court Probate Division in Costa Mesa. Some cases involving fraud, undue influence damages, or third-party financial misconduct may also involve civil court claims.

After a petition is filed, the case typically moves into discovery. During this stage, both sides exchange documents, request financial records, review medical history, take depositions, and gather witness testimony. This is where the facts are developed and the strength of each side’s position becomes clearer.

Many estate litigation cases go to mediation before trial. A neutral mediator helps the parties explore settlement, which can save time, reduce costs, and avoid the uncertainty of a court ruling. If the dispute cannot be resolved, the case proceeds to trial, where a probate judge hears evidence and issues a binding decision.

The Estate Lawyers, APC guides clients through each stage, explains what to expect before it happens, and manages the procedural pressure so families can stay focused on the bigger picture.

I don’t trust 90 percent of attorneys forever. I trust Ryan. My issue has been going on for nine years. I finally have traction and intend to prevail. After a court action in the New Year I will hire Ryan for the new actions.

Amy and her team are excellent. They formed the Special needs trust form my daughter and helped us with the administration of it during my daughter’s life. The law firm who we were dealing with the claim of the accident and who we are very grateful with, because of their humbleness and experience in accidents, they did what others firms didn’t even consider trying. After the accident case was settled, we needed a trust to receive the funds on behalf of my daughter and they try to set it up, but after a few hearing with the courthouse they just said, go see Amy, We did, and oh my goodness, they were able to set and get it approved in just one hearing. This is amazing for what I saw in the court room. Some cases NOT HANDLED by Amy, that I was able to hear during the several times we were in the court room with the accident attorney, some cases were already into 2 years and not resolved. When Amy took our case in her hands. Her staff was so professional that in the first try, the trust was approved by the court. In addition, they were very caring and supportive to us during the time of our relationship as client and attorney, and even though our relationship has ended after the passing of our daughter, I know that if in any case I need someone who I can fully trust blindly this is Amy and her team. If you are looking for fast, reliable and a accurate results look no more, Amy and associates is who you are looking for.

Sincerely

Sergio Mendoza

Joe Patton has been a terrific estate planning resource. He’s very knowledgeable and well-versed. He’s a higher-end attorney but he helped us understand the complexities of setting up a revocable trust and took the time to answer all of our questions candidly (and make suggestions surrounding those hypothetical circumstances). My husband and I feel very fortunate to know him and to know now that our affairs are in order should the unthinkable occur. We’d both highly recommend his counsel as we know him to be very hard-working and honest. He’s a good guy!
