How long does probate litigation actually take in California, and can it really drag on for years like people say?
Probate litigation in California typically runs anywhere from 12 months to several years, depending on the complexity of the estate and how aggressively parties fight. Cases involving will contests, trust disputes, or allegations of undue influence often take 18 to 36 months because of discovery, depositions, and court calendars in Orange County Superior Court.
What is the difference between contesting a will and contesting a trust, and does it matter which one I’m dealing with?
It matters a lot. Will contests go through the formal probate court process under the California Probate Code, while trust contests usually proceed as Probate Code Section 17200 petitions in the same court but with different procedural rules. Wills have stricter execution requirements, so grounds like improper witnessing can invalidate them.
My sibling was the caregiver and suddenly inherited everything. Is that automatically considered undue influence?
Not automatically, but California law gives you strong tools to challenge it. Under Probate Code Section 21380, gifts to a caregiver who is not related to the elder are presumed to be the product of fraud or undue influence, and the burden shifts to the caregiver to prove otherwise.
